These Service Terms apply to work Nuuch Systems ("Nuuch", "we", "us") does for you as a client: photography and video, websites, automation and AI, the AI receptionist, real estate media and creator coaching. Your quote describes the specific work; these terms cover everything else. Use of the website itself is covered by our Terms of Service.
1. Quotes and "from" prices
Prices on our website marked "from" are the starting price for the smallest version of that service. Before any work starts you get a written quote with one fixed price, what is included and a timeline. The quote is the price you pay unless you ask for more work, which we quote before doing. Quotes are in Canadian dollars unless they say otherwise and are valid for 30 days.
2. Payment
The $499 Content Starter is paid in full when you book. Larger projects take a 50% deposit to reserve the date or start the work, with the balance due before launch or handover. Monthly plans are billed in advance each month. We accept the payment methods shown on your invoice.
3. Deposits
A deposit is refundable if you cancel within 48 hours of booking. After that it is not refunded, but it is credited in full to a rescheduled date or a later start within six months.
4. Rescheduling and weather
You can reschedule a shoot or a session free of charge with at least 48 hours' notice. If the weather makes an outdoor shoot unsafe or unusable, we agree a new date at no cost. With less than 48 hours' notice we may charge a rescheduling fee, which we tell you about before you confirm.
5. If you are not there
If nobody is available at the agreed time and place for a shoot or session and we have not heard from you, we count it as a late cancellation. The deposit is kept and a new date is quoted as a new booking.
6. Revisions
Websites include two rounds of revisions. Photo packages include one round of minor edits (crops, colour and small clean-ups, not re-shoots). Coaching sessions have no revisions; you can book more time. Extra rounds or bigger changes are billed at an hourly rate quoted in advance, and we start only when you approve it.
7. Project pauses
Projects need your input: content, logins, approvals and feedback. If we have asked for something and heard nothing for 30 days, we pause the project. Restarting may mean a new timeline, and if more than six months pass we may treat the project as complete and invoice the work done.
8. Photos and video: what you can do with them
When the project is paid for, you get a perpetual, worldwide licence to use the finished photos and videos for your own business, including on your website, social media, listings, print and paid ads. Nuuch keeps the copyright and may show the work in our portfolio, website and social media unless you ask us not to. You may not resell the files or license them to others as stock. RAW files and unedited footage are not included.
9. Websites: what you own
Once the final balance is paid, the finished site files belong to you. Your domain and hosting are registered in your name and paid for by you, so you are never locked in. Care plans are month to month. If you leave, we hand over the site files and DNS settings and walk you through what to do with them. Third-party themes, plugins, fonts and stock images stay under their own licences.
10. Third-party subscriptions
Many projects use tools we do not own: CRMs, booking systems, SMS and email services, website hosting, and the AI platform's call minutes. These are set up in your name and billed to you by the provider. We show the expected costs in your quote. We are not responsible for price changes, outages or policy changes made by those providers.
11. AI receptionist
Your AI receptionist always tells callers it is a virtual assistant. Calls may be recorded and transcribed so we can tune the answers; callers are told this at the start of the call. The service depends on third-party telephony and AI platforms (currently Retell AI), so we monitor it but cannot promise 100% uptime. If it is unavailable, calls fall back to your own phone or voicemail. Each monthly plan includes up to 300 call minutes; extra minutes are $0.20 each (CAD). Follow-up texts are included. If your plan ends, the receptionist stops answering, call forwarding is removed and you keep your phone number. You are responsible for the accuracy of the business information you give it to share with callers.
12. Monthly plans
Monthly plans (AI receptionist, website care, automation support) run month to month and can be cancelled by either side with 30 days' written notice. When a plan ends, the ongoing service stops: the receptionist stops answering, monitoring and updates stop, and automations that rely on our accounts are handed over or switched off. Anything you have paid for in full stays yours.
13. Our responsibility
We do the work carefully and fix what is not right. If something goes wrong, our total responsibility for any claim related to a project is limited to the fees you paid us for that project. We are not responsible for lost profits or indirect losses, or for outcomes that depend on third parties, such as search rankings, ad results or platform availability.
14. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there.
15. Changes
We may update these terms from time to time. The version in force when you accept a quote is the one that applies to that project.
